গোপনীয়তা নীতিমালা

যখন আপনি চট্টগ্রাম সিটি কর্পোরেশন (চসিক)-এর নির্দেশনায় “ডকইয়ার্ড অ্যান্ড ইঞ্জিনিয়ারিং ওয়ার্কস লিমিটেড, বাংলাদেশ নৌবাহিনী” (ডেভেলপার) কর্তৃক তৈরিকৃত **“আমাদের চট্টগ্রাম- সিটিজেন পোর্টাল ফর চসিক”** (“অ্যাপ”) ব্যবহার করবেন, তখন আপনার কাছ থেকে এবং আপনার সম্পর্কে কিছু ব্যক্তিগত তথ্য সংগ্রহ করা হবে। আপনি এতদ্বারা আপনার ভৌগোলিক অবস্থানসহ (geo location) এই ধরনের ব্যক্তিগত তথ্য সংগ্রহ, সংরক্ষণ, ব্যবহার, সরবরাহ, আদান-প্রদান এবং বিশ্লেষণের জন্য স্পষ্টভাবে সম্মতি প্রদান করছেন। আমরা এই তথ্যের নিরাপত্তা রক্ষা এবং আপনার গোপনীয়তা বজায় রাখতে প্রতিশ্রুতিবদ্ধ। এই নীতিমালায় সংগৃহীত ব্যক্তিগত তথ্যের বিবরণ, সংগ্রহের পদ্ধতি, কার দ্বারা সংগৃহীত এবং কী উদ্দেশ্যে ব্যবহৃত হবে তার বিস্তারিত উল্লেখ করা হয়েছে। নিবন্ধনের সময় আপনি এই গোপনীয়তা নীতিমালার শর্তাবলী গ্রহণ করেছেন এবং আপনার অ্যাপ ব্যবহার অব্যাহত রাখা মানেই হলো আপনি এটি মেনে চলছেন। এই নীতিমালা সময়ে সময়ে সংশোধন করা হতে পারে। বর্তমান সংস্করণ সম্পর্কে অবহিত থাকতে দয়া করে নিয়মিত অ্যাপটি চেক করুন। সংশোধিত নীতিমালা অ্যাপে প্রকাশের তারিখ থেকে কার্যকর হবে। অ্যাপটি ব্যবহার চালিয়ে যেতে আপনাকে পর্যায়ক্রমে সংশোধিত শর্তাবলীতে সম্মতি প্রদান করতে হবে।

### **১. তথ্য সংগ্রহ এবং সংগ্রহের পদ্ধতি**

(ক) আপনি যখন অ্যাপে নিবন্ধন করবেন, তখন আপনার ফোন নম্বর সংগ্রহ করা হবে এবং একটি সিস্টেম-জেনারেটেড ওটিপি (OTP) কোড আপনাকে প্রদান করা হবে। নিবন্ধনের সময় আপনার কাছ থেকে সংগৃহীত তথ্য চসিক এর পক্ষে পরিচালিত একটি সার্ভারে (সার্ভার) নিরাপদে সংরক্ষণ করা হবে। এই তথ্যটি আপনার অ্যাপে প্রেরিত একটি অনন্য নম্বরের (Unique Number) বিপরীতে সংরক্ষিত থাকবে। পরবর্তীতে অ্যাপ সংক্রান্ত সকল লেনদেনে আপনাকে শনাক্ত করতে এই অনন্য নম্বরটি ব্যবহৃত হবে এবং অ্যাপ থেকে সার্ভারে আপলোড করা যেকোনো ডেটা বা তথ্যের সাথে এটি যুক্ত থাকবে। নিবন্ধনের সময় আপনার অবস্থানের তথ্যও (Location details) সংগ্রহ করে সার্ভারে আপলোড করা হবে।

(খ) অ্যাপটি ক্রমাগত আপনার জিপিএস (GPS) লোকেশন ডেটা সংগ্রহ করে এবং প্রতি ১০ সেকেন্ড অন্তর আপনি কোথায় কোথায় ছিলেন তার একটি রেকর্ড আপনার মোবাইল ডিভাইসে নিরাপদে সংরক্ষণ করে।

### **২. তথ্যের ব্যবহার**

ধারা ১(ক)-এর অধীনে নিবন্ধনের সময় সংগৃহীত আপনার ব্যক্তিগত তথ্য সার্ভারে সংরক্ষিত থাকবে এবং চসিক এলাকার সমস্যাসমূহ ব্যবস্থাপনার উদ্দেশ্যে রিপোর্ট, হিট ম্যাপ (Heat Maps) এবং অন্যান্য পরিসংখ্যানগত চিত্র তৈরির জন্য চসিক কর্তৃক ব্যবহৃত হবে।

### **৩. তথ্য সংরক্ষণ (Retention)**

ধারা ১(ক)-এর অধীনে সংগৃহীত সকল ব্যক্তিগত তথ্য আপনার অ্যাকাউন্ট সচল থাকা পর্যন্ত এবং পরবর্তীতে প্রচলিত আইন অনুযায়ী প্রয়োজনীয় সময় পর্যন্ত সংরক্ষণ করা হবে।

ধারা ১(খ)-এর অধীনে সংগৃহীত এবং সার্ভারে আপলোড করা তথ্যসমূহ চসিক এর বিবেচনায় যদি আর কোনো প্রয়োজন না থাকে, তবে তা সার্ভার থেকে মুছে ফেলা (Purge) হতে পারে।

নিবন্ধিত ব্যবহারকারীদের ব্যক্তিগত ডেটা থেকে তৈরি করা সমষ্টিগত ডেটাসেট (Aggregated Datasets) বা উক্ত ডেটাসেট ব্যবহার করে তৈরি কোনো রিপোর্ট, হিট ম্যাপ বা পরিসংখ্যানগত চিত্রের ক্ষেত্রে এই শর্ত প্রযোজ্য হবে না।

### **৪. ডেটা নিরাপত্তা**

আপনার তথ্যের গোপনীয়তা এবং নিরাপত্তা নিশ্চিত করতে অ্যাপটি মানসম্মত নিরাপত্তা ব্যবস্থায় সজ্জিত। ডেটা আদান-প্রদান (In transit) এবং সংরক্ষণের (At rest) সময় এনক্রিপ্ট করা থাকে। নিবন্ধনের সময় প্রদান করা তথ্য ক্লাউডে আপলোড করার আগেই এনক্রিপ্ট করা হয় এবং একটি নিরাপদ এনক্রিপ্টেড সার্ভারে রাখা হয়। অন্যান্য ব্যবহারকারীদের অ্যাপে সংরক্ষিত তথ্য, যাদের সংস্পর্শে আপনি আসতে পারেন, তাও সুরক্ষিতভাবে এনক্রিপ্ট করা থাকে এবং অন্য কোনো ব্যবহারকারী তা অ্যাক্সেস করতে পারেন না।

### **৫. দায়মুক্তি (Disclaimer)**

চট্টগ্রাম সিটি কর্পোরেশন (চসিক) এর ওয়েবসাইট বা মোবাইল অ্যাপ্লিকেশনের মাধ্যমে ‘আমাদের চট্টগ্রাম- সিটিজেন পোর্টাল’-এ প্রদত্ত যেকোনো তথ্য, বিষয় বা সুবিধা/সেবার ব্যবহার এবং এর ওপর নির্ভরতা সম্পূর্ণভাবে আপনার নিজস্ব ঝুঁকিতে থাকবে।

আপনি চসিক এর মালিকানা ও কপিরাইট স্বত্ব বজায় রাখা সাপেক্ষে সাইটে প্রদর্শিত উপকরণসমূহ ডাউনলোড করতে পারেন। তবে, চসিক এর লিখিত অনুমতি ব্যতীত আপনি টেক্সট, ছবি, অডিও এবং ভিডিওসহ সাইটের কোনো বিষয়বস্তু জনসমক্ষে বা বাণিজ্যিক উদ্দেশ্যে বিতরণ, পরিবর্তন, প্রেরণ, পুনরায় ব্যবহার বা রিপোর্ট করতে পারবেন না। চসিক যেকোনো সময় কোনো পূর্ব নোটিশ বা কারণ ছাড়াই এই ওয়েবসাইট/মোবাইল অ্যাপ্লিকেশনের যেকোনো কিছু (কারিগরি/অ-কারিগরি তথ্য, ডেটা, পরিসংখ্যান, স্টাইলিং বা পরিচালনা পদ্ধতিসহ) পরিবর্তন বা পরিমার্জন করার অধিকার সংরক্ষণ করে।

এখানে অন্তর্ভুক্ত সকল তথ্য/ডেটা শুধুমাত্র রেফারেন্স এবং নির্দেশিকা হিসেবে ব্যবহারের জন্য এবং এগুলো চসিক এর কাছে থাকা রেকর্ডের ওপর ভিত্তি করে তৈরি। তথ্যের সঠিকতা যাচাইয়ে সর্বোচ্চ সতর্কতা অবলম্বন করা হলেও, চসিক বা এর কোনো কর্মকর্তা বা ভেন্ডর তথ্যের নির্ভুলতা বা এর ব্যবহারের ফলে উদ্ভূত কোনো ক্ষতির জন্য দায়বদ্ধ থাকবে না। ওয়েবসাইট/অ্যাপে প্রদর্শিত তথ্যের ব্যবহারের ফলে সৃষ্ট কোনো দাবির জন্য চসিক দায়ী নয়। এখানকার তথ্য আইনগত বিবৃতি হিসেবে বা কোনো আইনি উদ্দেশ্যে ব্যবহার করা উচিত নয়। তথ্যের ভিত্তিতে আপনার গৃহীত যেকোনো পদক্ষেপ আপনার নিজস্ব ঝুঁকিতে হবে এবং এর ফলে সৃষ্ট কোনো ব্যয়, ক্ষতি বা পরোক্ষ ক্ষতির জন্য চসিক দায়ী থাকবে না।

এই পোর্টালের সকল সেবা অন্যান্য ব্যাক-এন্ড সিস্টেমের সাথে অনলাইনে যুক্ত। তাই এই সেবাগুলোর প্রাপ্যতা ব্যাক-এন্ড সিস্টেমের ওপর নির্ভরশীল। কোনো সেবা সাময়িকভাবে পাওয়া না গেলে চসিক তার জন্য দায়ী থাকবে না, তবে সাপোর্ট টিম দ্রুত সমস্যা সমাধানের চেষ্টা করবে।

### **৬. অভিযোগ প্রতিকার (Grievances)**

গোপনীয়তা নীতিমালা, নিরাপত্তা ইস্যু বা মেধা সম্পদ অধিকার সংক্রান্ত কোনো উদ্বেগ বা প্রশ্ন থাকলে আপনি চসিক এর অভিযোগ প্রতিকার ফোকাল পয়েন্টের ইমেইলে যোগাযোগ করতে পারেন: **ap2@ccc.gov.bd**

আমাদের চট্টগ্রাম মোবাইল অ্যাপ্লিকেশনের ব্যবহারকারীরা যেকোনো সময় তাদের অ্যাকাউন্ট এবং সংশ্লিষ্ট ব্যক্তিগত তথ্য মুছে ফেলার অনুরোধ করার অধিকার রাখেন।

অ্যাকাউন্ট মুছে ফেলার অনুরোধ জমা দিতে, ব্যবহারকারীরা নিচের লিংকে যেতে পারেন:

একটি বৈধ অনুরোধ পাওয়ার পর:
- ব্যবহারকারীর সকল ব্যক্তিগত তথ্য যেমন নাম, ফোন নম্বর এবং প্রোফাইল তথ্য স্থায়ীভাবে মুছে ফেলা হবে
- ব্যবহারকারীর তৈরি করা কনটেন্ট যেমন রিপোর্ট/ইস্যুসমূহ মুছে ফেলা হবে অথবা নামবিহীন (anonymized) করা হবে

ডাটা সংরক্ষণ নীতি:
- নিরাপত্তা, প্রতারণা প্রতিরোধ এবং আইনি প্রয়োজনের জন্য কিছু সিস্টেম লগ সর্বোচ্চ ৩০ দিন পর্যন্ত সংরক্ষণ করা হতে পারে
- এই সময়সীমা শেষে সংশ্লিষ্ট সকল তথ্য স্থায়ীভাবে মুছে ফেলা হবে

প্রক্রিয়াকরণের সময়:
- যাচাইকরণের পর অ্যাকাউন্ট মুছে ফেলার অনুরোধ ৭ কার্যদিবসের মধ্যে সম্পন্ন করা হয়

Terms and Conditions

These terms of service (“the Terms”) govern your use of the Citizen Management Portal application (“the App”) developed by “Walletmix Limited” (“the Developer”) as per instructions of Dhaka North City Corporation for mobile and handheld devices and the services provided thereunder. Please read these terms and conditions (“the Terms”) carefully before you download, install or use the App. By clicking on the “I Agree” button, you signify your acceptance of the Terms, in its entirety, and your intention to be legally bound by them.

  1. 1. SERVICE OVERVIEW

    The App is part of a service designed to enable registered users who have any issue regarding the DNCC areas and the registered users can also avail the DNCC services. The app acts as a one-stop solution for the DNCC citizens and their information that they provided will be stored for future reference and use.

  2. 2. REQUIREMENTS FOR USE

    You agree to turn on and allow the App access to the Camera, Storage, GPS Location, Phone Call, Network State, and Send SMS service on your mobile or handheld device. You acknowledge that if your device is switched off or in airplane mode, if Camera and GPS services on your device are turned off or if you revoke the App’s access to Camera and GPS services on your device, it will not be able to capture all necessary information which will impair the completeness and accuracy of the Services. You agree to keep the mobile or handheld device on which the App is installed in your possession at all times and not to share it with or allow anyone else to use it.

  3. 3. USE

    You agree that you will only use the App in good faith and will not provide false or misleading information about yourself or about the raised issue. You agree that you will not do anything to throttle, engineer a denial of service, or in any other manner impair the performance or functionality of the App. You agree that you will not tamper with, reverse-engineer or otherwise use the App for any purpose for which it was not intended including, but not limited to, accessing information about registered users stored in the App, identifying or attempting to identify other registered users or gaining or attempting to gain access to the cloud database of the Service.

  4. 4. DATA COLLECTION, SECURITY OF USERS AND IP RIGHTS

    You hereby expressly consent in sound mind and good health, to the collection, analyzing, acquiring, possessing, supplying and use of your personal information and geo-location for the provision of the Services. The details of the personal information collected and the manner in which it is collected as well as the purposes for which it will be used is more fully set out in our privacy policy. Any information collected through this App will be used for the sole purpose for which this App has been developed. The Developer/Walletmix Limited shall not be responsible for any unauthorized usage of data by the persons entrusted with accessing user data by the DNCC. You are free to choose not to provide this information at any time by suspending the App’s access to Camera, Storage, Phone Call, Send SMS Service, Network State and GPS services or by deleting the App from your mobile or handheld device. However, should you do so, you acknowledge that you will no longer be able to avail of the Services. However, our Terms do not allow you to violate or damage or endanger someone else's intellectual property rights when using our Services, including removing, altering or concealing their copyrights, trademarks, service marks or other proprietary rights, notices incorporated in or accompanying this App.

  5. 5. DISRUPTION

    You agree that you have no expectation of, or right to permanent and uninterrupted access to the Services. While the Services are intended to be accessible to you from everywhere on a 24x7 basis, from time to time and without prior notice of downtime, access to the App or the Services or to any part thereof may be suspended on either a temporary or permanent basis and either with respect to all or a certain class of users.

  6. 6. LIMITATION OF LIABILITY

    You agree and acknowledge that the DNCC or Walletmix Limited will not be liable for any claims in relation to the use of the App, including but not limited to (a) your inability to access or use the App or the Services; (b) any unauthorized access to your information or modification thereof.

  7. 7. DISCLAIMER

    The App is being made available on an "as-is" basis and the DNCC or Walletmix Limited makes no warranties of any kind, whether express, implied, statutory or otherwise, with respect to the functioning of the App. Whilst the App endeavors to ensure that the information provided by this App is correct, it does not warrant its completeness or accuracy; nor does it commit to ensuring that the app remains available or that the material on the app is kept up-to-date.

    To the maximum extent permitted by applicable law all representations, warranties and conditions relating to this app and the use of this app (including, without limitation, any warranties implied by law of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill) are excluded.

    All services such as those provided by this App are never wholly free from defects, errors and bugs, and the Developer provides no warranty or representation to that effect or that the App will be compatible with any application, or software not specifically identified as compatible. The functioning of the App is dependent on the compliance by all registered users of the App with these Terms. Accordingly, the Developer and DNCC disclaim all liability on account of such non-compliance by other registered users.

  8. 8. GOVERNING LAW

    These Terms and conditions will be governed by and construed in accordance with the laws of People’s Republic of Bangladesh, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of Bangladesh.

  9. 9. REVISION OF TERMS AND CONDITIONS

    The Terms may be amended from time to time. Revised Terms will apply to the use of the App from the date of the publication of the revised Terms on the App. Please check the App regularly to ensure you are familiar with the current version. For certain revision of terms in order to continue using the App, you will be required to accept the revised Terms. Failure to comply with the Terms can result in suspension of your ability to use the App.

  10. 10. SEVERABILITY

    If a provision of these Terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue to be in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Privacy policy

When you use Citizen Management Portal (App), some personal information is collected from and about you. You hereby expressly give consent to such collection, store, use, supply, share, analysis of such personal information including your geo location. We are committed to protecting the security of this information and safeguarding your privacy. This privacy policy sets out the details of the personal information collected, the manner in which it is collected, by whom as well as the purposes for which it is used. At registration you accepted the terms of this Privacy Policy and your use of the App signifies your continued acceptance thereof. This Privacy Policy may be revised from time to time. Please check the app regularly to ensure you are familiar with the current version. Revised privacy policy will apply to the use of the app from the date of the publication of revised privacy policy on the app. In order to use the App, you will be required to consent to the terms of the Privacy Policy as revised from time to time.

  1. 1. INFORMATION COLLECTED AND MANNER OF COLLECTION

    When you register on the App, your phone number is collected and a system-generated OTP code is assigned to you. The information collected from you during registration is stored securely on a server managed by/ on behalf of the DNCC (Server). This information stored on the Server will be stored against with a unique number that is pushed to your App. The unique number will thereafter be used to identify you in all subsequent App related transactions and will be associated with any data or information uploaded from the App to the Server. At registration, your location details are also captured and uploaded to the Server.

    The App continually continuously collects your GPS location data and stores securely on your mobile device, a record of all the places you have been at 10 seconds interval.

  2. 2. USE OF INFORMATION

    The personal information collected from you at the time of registration under Clause 1(a) above, will be stored on the Server and only be used by the DNCC for the purpose of generating reports, heat maps and other statistical visualizations for the purpose of the management of the issues in the DNCC areas.

  3. 3. RETENTION

    All personal information collected from you under Clause 1(a) at the time of registration will be retained for as long as your account remains in existence and for such period thereafter as required under any law for the time being in force.

    All information collected under Clause 1(b) and uploaded to the Server may be purged from the Server at the discretion of the DNCC if the data is deemed to have no further value.

    Nothing set out herein shall apply to the aggregated datasets generated by the personal data of registered users of the App or any reports, heat maps or other visualization created using such datasets.

  4. 4. DATA SECURITY

    The App is equipped with standard security features to protect the confidentiality and security of your information. Data is encrypted in transit as well as at rest. Personal information provided at the time of registration is encrypted before being uploaded to the cloud where it is stored in a secure encrypted server. Personal information that is stored in the Apps of other registered users that you come in contact with is securely encrypted and is incapable of being accessed by such users.

  5. 5. GRIEVANCES

    If you have any concerns or questions in relation to Privacy Policy, Security issues or intellectual property rights you may address them to the Grievance Redress focal point at DNCC’s email syst@dncc.gov.bd
